These terms of service ("Terms") govern your use of the Desert Bloom Pool Care website at desertbloompoolcare.com ("Website") and any pool cleaning, maintenance, repair, or related services ("Services") provided by Desert Bloom Pool Care ("Company," "we," "us," or "our"). By using our Website or hiring us for Services, you agree to these Terms. If you do not agree, please do not use our Website or Services.

Agreement to Terms

By accessing our Website or requesting Services, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. These Terms apply to all visitors, customers, and anyone who accesses or uses the Website or Services. We may update these Terms from time to time. Continued use of the Website or Services after changes are posted constitutes your acceptance of the updated Terms.

Services Overview

Desert Bloom Pool Care provides residential pool cleaning, chemical maintenance, tile cleaning, acid washing, filter cleaning, equipment repair, equipment replacement, and new pool orientation services throughout the East Valley region of Arizona, including Gilbert, Chandler, Mesa, Tempe, Queen Creek, San Tan Valley, Apache Junction, Gold Canyon, and Ahwatukee. Service availability, pricing, and scheduling are subject to change at our discretion. We reserve the right to decline service for any reason, including but not limited to unsafe pool conditions, accessibility issues, or unpaid balances from prior service.

Quotes and Estimates

All estimates provided by Desert Bloom Pool Care are based on a visual inspection of your pool and equipment at the time of the estimate visit. Estimates are provided free of charge and carry no obligation. Final pricing may differ from the initial estimate if the actual condition of the pool, equipment, or plumbing differs from what was visible during the estimate visit. We will communicate any price adjustments before performing additional work. Written quotes are valid for 30 days from the date of the estimate unless otherwise stated.

Service Scheduling and Access

Weekly pool service is performed on a consistent day each week, weather and holidays permitting. You are responsible for providing safe, unobstructed access to your pool and equipment. This includes ensuring gates are unlocked or providing gate codes, restraining pets on service days, and maintaining a clear path to the pool area. If our technician cannot safely access your pool on the scheduled day, the visit may be skipped without credit. We will notify you if access is an issue.

Payment Terms

Weekly pool service is billed monthly. Payment is due upon receipt of the invoice. One-time services such as tile cleaning, acid washing, filter cleaning, equipment repair, and equipment replacement are billed upon completion and payment is due upon receipt. We accept major credit cards, debit cards, and ACH bank transfers. Accounts with balances overdue by more than 30 days may have service suspended until the balance is resolved. We do not charge late fees, but we reserve the right to discontinue service for non-payment.

Cancellation and Pausing Service

Weekly pool service can be paused or canceled at any time with one week of notice. We do not require contracts and we do not charge cancellation fees. If you need to pause service for vacation, seasonal absence, or any other reason, contact us and we will hold your service and resume it when you return. Refunds are not issued for partial months of completed service.

Permits and Compliance

For services that involve draining a pool (such as acid washing), you are responsible for ensuring that any required permits or approvals from your city, HOA, or water district are obtained before the service date. Desert Bloom Pool Care will advise you on local requirements we are aware of, but the homeowner is ultimately responsible for compliance with local regulations regarding water discharge, noise restrictions, and access rules. We comply with all applicable Maricopa County and Pinal County environmental regulations for pool service work.

Limitation of Liability

Desert Bloom Pool Care provides Services with reasonable care and skill. However, we are not liable for pre-existing conditions including but not limited to hidden plumbing leaks, structural defects, equipment deficiencies not visible during inspection, or damage caused by prior service providers. Our total liability for any claim related to Services shall not exceed the amount paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including but not limited to property damage resulting from pre-existing conditions, water loss from undiscovered leaks, or equipment failure due to age or prior neglect.

Use of Website

You may use our Website for personal, non-commercial purposes related to learning about our Services, contacting us, or requesting estimates. You may not use the Website to distribute spam, malware, or any harmful content. You may not scrape, copy, or reproduce the content of our Website without written permission. All content on the Website, including text, images, and design, is the property of Desert Bloom Pool Care or its licensors and is protected by copyright law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising from these Terms or from Services provided by Desert Bloom Pool Care shall be resolved in the courts of Maricopa County, Arizona.
